General Terms and Conditions (GTC)

These General Terms and Conditions (GTC) apply to all bookings, reservations and the use of the X-Park Airport platform.

By using the platform, the customer accepts these GTC.

X-Park Airport does not operate any parking facilities itself and does not provide any parking services.

X-Park Airport solely provides a brokerage and booking platform between customers and independent parking providers.

The contract for the parking service is concluded exclusively between the customer and the respective parking provider.

Bookings are made exclusively online via the platform.

After a successful booking, the customer receives a booking confirmation by email.

Upon dispatch of the booking confirmation, the brokerage service of X-Park Airport is deemed to have been rendered.

All bookings must be paid in full online before the start of the parking period.

Payment processing is handled by X-Park Airport or the payment service providers used (e.g. Stripe Connect).

X-Park Airport reserves the right to offer additional payment methods in the future.

Prices are set by the respective parking provider.

All prices displayed at the time of booking are binding.

All prices include the applicable statutory value added tax, unless stated otherwise.

Depending on the provider, the following services in particular may be offered:

• Shuttle service
• Valet service
• Multi-storey (garage) parking
• Outdoor parking
• Vehicle drop-off and vehicle return
• Additional services (e.g. car wash, EV charging)

The exact scope of services is set out in the respective offer description.

The following details can be changed retrospectively, where technically possible:

• Flight number
• Telephone number
• Number of travellers

The following changes are not possible:

• Changing the arrival date
• Changing the departure date

In these cases, a new booking is required.

Free cancellation is possible up to 24 hours before the booked start of the parking period.

In the event of a cancellation less than 24 hours before the start of the parking period, there is generally no entitlement to a refund.

In the event of a no-show, no refund will be issued.

The customer undertakes to

• provide complete and correct information,
• keep their flight details up to date,
• follow the instructions of the parking provider,
• arrive punctually at the agreed time.

Each parking provider undertakes in particular to

• comply with all statutory regulations,
• hold a valid business registration,
• maintain adequate business liability insurance,
• provide correct prices and availability,
• perform the booked services properly.

The respective parking provider is liable in particular for:

• Damage to vehicles
• Loss of vehicle keys
• Damage caused by employees
• Damage occurring during the parking process
• Shuttle service
• Valet service
• Delays in the provision of services

X-Park Airport accepts no liability for damage or breaches of duty that fall within the area of responsibility of the parking provider.

Customers may submit reviews after a booking.

X-Park Airport reserves the right to review submissions and to remove unlawful, offensive, false or misleading content.

There is no entitlement to the publication of a review.

Complaints about the parking service must first be addressed to the respective parking provider.

X-Park Airport supports the customer, to the extent possible, in the communication between the parties.

A refund is issued in particular

• in the event of a cancellation within the applicable deadline,
• if the parking provider is unable to provide the booked service.

Each case is reviewed and processed individually.

If a parking provider is unable to provide the booked service, X-Park Airport will, where possible, endeavour to arrange an equivalent replacement solution.

If this is not possible, the amount paid will be refunded in accordance with the statutory provisions and the agreements with the provider.

Payment processing is carried out via Stripe Connect or other payment service providers used.

X-Park Airport accepts payments exclusively within the scope of its brokerage role.

The following in particular are prohibited:

• False bookings
• Fraudulent activities
• Manipulation of reviews
• Improper use of the platform

X-Park Airport may suspend user accounts or cancel bookings if misuse is identified.

Where customer accounts are offered, the user is responsible for keeping their access credentials confidential.

All actions carried out via the customer account are deemed to have been initiated by the account holder, to the extent permitted by law.

Communication takes place electronically by email as a matter of principle.

Booking confirmations, information and notifications are sent to the email address provided by the customer.

X-Park Airport endeavours to keep the platform available with as little interruption as possible.

Maintenance work, technical faults or force majeure may lead to temporary restrictions.

There is no entitlement to availability at all times.

Personal data is processed in accordance with the Privacy Policy and the applicable data protection laws, in particular the GDPR.

No liability is accepted for events beyond the control of X-Park Airport or the parking provider, in particular natural disasters, strikes, pandemics, official measures or other unforeseeable events, to the extent permitted by law.

Mandatory statutory consumer rights remain unaffected by these GTC.

The law of the Federal Republic of Germany applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by law.

To the extent permitted by law and where the customer is a merchant or a legal entity under public law, the place of jurisdiction is the registered office of X-Park Airport.

For consumers, the statutory rules on jurisdiction apply.

Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by the statutory provision.
